Stopped in their tracks; Online privacy.(A proposed privacy law in America could help web companies as well as hurt them)

A proposed privacy law could help as well as hurt America's web companies

THE outcry over internet firms' habit of surreptitiously tracking web surfers' activities has clearly resonated inside the White House. On March 16th the Obama administration announced that it intends to work with Congress to produce "a privacy bill of rights" giving American consumers greater control over how their information is collected and used by digital marketers.

Those who have been lobbying for change agree with, but are unsympathetic to, internet firms' worries that such a law could dent their advertising-driven business models, which rely on tracking and targeting consumers to maximise revenues. "This is dimming the prospects of Google, Facebook and other digital ad companies," says Jeffrey Chester of the Centre for Digital Democracy.

Quite how dark things get for them will depend on the details of the bill. It will seek to lay down the basic principles of internet privacy rights, broadly following recommendations published last December by the Department of Commerce. The department's report said consumers should be told more about why data are being collected about them and how they are used; and it called for stricter limits on what companies can do with information they collect.

Whatever legislation finally emerges is likely to give a broader role to the Federal Trade Commission (FTC), which will almost certainly be charged with deciding how those principles are translated into practice and with policing their implementation. Among other things, the FTC is known to be keen on a formal "do not track" system, which would allow users to block certain sites from monitoring their online activities.

Keen to avoid this, the online-advertising industry has been working overtime to convince policymakers that it can police itself using systems such as icons on web pages that show surfers when they are being tracked. And it is telling anyone who will listen that consumers will suffer if tough do-not-track rules hit ad revenues, forcing web firms to charge for more content.

With Mr Obama throwing his weight behind internet privacy, this rearguard action is less likely to be successful. Some ad firms have started talking of creating a do-not-track system of their own, that would limit the damage to their digital activities. Microsoft and Mozilla, two tech giants, have recently said they are including do-not-track features in new versions of their respective web browsers, Internet Explorer and Firefox.

Although all this may dent their revenues, America's internet giants could also benefit from the legislation if it helps them in their dealings with the European Union. The EU's already fairly strict rules on privacy--which it considers a fundamental human right--are being tightened further. The time-consuming and expensive legal hoops the EU makes American internet firms jump through, to be allowed to handle Europeans' online data, will become more demanding.

If by passing its own online-privacy "bill of rights" America can convince the EU to ease this legal burden, then it will be an important win for American companies, says Joel Reidenberg, a professor at Fordham University's law school. Google, Facebook and others will no doubt be tracking--both online and offline--the progress of EU-American talks on this matter very closely.

The chips are down for an online gambling rout; Tax penalties primed to halt the offshore gaming firms' winning streak.(Business)

Byline: SARAH BRIDGE

Bright logos and promises of untold riches are everywhere to lure the gamblers. The adverts appear during the breaks on television, next to the rugby pitch, sponsoring horse races and even plastered over the shirts of football players.

Millions of pounds every year are spent by companies such as Sportingbet, Party-Gaming, 888.com, William Hill and Ladbrokes on promoting their websites.

Yet those millions of pounds are available only because of the highly generous tax breaks that these companies enjoy by virtue of being located in a variety of offshore tax havens - from the Channel Islands to the Isle of Man and from Gibraltar to Malta.

None of the companies pays more than one per cent tax compared with the 15 per cent they would face on the British mainland.

But their luck may be about to run out and there are fears within the industry that the almost tax-free - and totally legal - status enjoyed by the off-shore gaming industry could be drawing to a close.

Within weeks the Department for Culture, Media and Sport is to announce the longawaited results of its consultation into regulating remote gaming - offered through the internet and via phones

It is expected to announce that in line with other European countries, every offshore gaming company must get a British-specific licence on top of the one it will already have from the country where it operates. If they the theory goes, they should be licensed here.

The industry is generally relaxed about this as most companies are licensed in countries that already have strict regulations. They will just have to bear the cost of getting an extra licence.

But alarm bells are ringing as many see this as the first step towards changing the tax regime covering offshore companies.

'People are assuming that the licensing regulation will lead to changes in taxation,' said one industry source.

'It's the thin end of a taxation wedge. At the moment, offshore gambling operators pay next to nothing in tax, which is why they went offshore in the first place. But there is an expectation that the rate could be put up to match the 15 per cent which UK-based operators currently pay. We'd be amazed if the Treasury wasn't already looking at this.'

Ian Burke, chief executive of Rank Group, which bases its offshore operations in Alderney in the Channel Islands, said: 'Many European markets are moving to regulating and taxing online gaming and it's inevitable that the UK government will look at changing the offshore tax regime.'

The effect of paying 15 per cent rather than one per cent could be highly significant. First, there is the direct economic impact to consider. Practically every single operator in online gaming is offshore, from the purely online companies such as Party Gaming and 888.com to the more traditional players such as William Hill, Ladbrokes, Betfred and even the State-owned Tote. The rare few that still have online operations based in the UK include Bet365 and betting exchange Betfair, although the latter is currently considering whether to decamp. Companies could be hit to the tune of millions of pounds each, depending on how big their offshore operations are.

Burke warned: 'Weaker companies would disappear as their business model would no longer be sustainable.'

Clive Hawkswood, chief executive of the Remote Gambling Association, said any tax changes would 'clearly hit companies hard'.

He added: 'Some online casinos have a payout rate of about 97 per cent so there is no room to withstand such a jump in tax.'

To survive, said Hawkswood, they would have to cut back dramatically on marketing, which has been lucrative for the media and sports industries.

Analysts reckon that the online gaming sector is worth about [pounds sterling]1.5 billion a year. With some companies spending about 30 per cent of their total revenues on advertising, there is a lot at stake.

Many of the major operators such as Rank and William Hill say they are happy to pay more tax, but only if the entire industry does the same. 'We're not arguing against changes in taxation,' said Burke, 'but we want to see it done across the board, not in the patchwork quilt it is now.'

For example, Burke said that roulette, one of the classic casino games, was taxed at anything between zero per cent and 50 per cent, depending on where the game was played. Gross profits from roulette attract no tax online, but a small casino would have to pay 15 per cent tax while Rank's flagship Victoria casino in London, which has greater revenues, would attract the top rate of 50 per cent.

Burke said: 'This Government seems to be in favour of simplifying the tax regime for some aspects of gambling and we'd urge them not to do it in a piecemeal way. We'd rather have a flat rate across the board and for the effect to the revenue to be the same.'

Once the Department for Culture report is released, Hawkswood said he 'would be very quickly engaging in talks with the Treasury about its plans'.

Licensing changes would need legislation and the Government already has a packed timetable. But no one is betting against the end of the gaming tax havens.

Indonesia.(BROADCASTING)

According to Jaydeep Chaudhuri, managing director, MEC Indonesia, on a national level, the estimated penetrations of various media across urban and rural centres are TV - 82 percent; newspapers - 14 percent; magazines - 12 percent; radio - 38 percent; and the internet - 7 percent.

For people reached by the media - TV audiences spend about 210 minutes per day with the medium, as opposed to 60 minutes per day for radio audiences and a low 30 minutes for newspaper readers.

Terrestrial TV is by far the lead medium - with no threat in sight in the immediate future, according to Chaudhuri. Pay TV however has a very low penetration - with only about 2 million households across Indonesia estimated to have a pay TV connection.

Readership of all print vehicles - newspapers, magazines, tabloids - are steadily decreasing. The internet - across multiple devices - is rapidly picking up, and TV is stable. In measured media - about 60 percent of ad revenue goes to television, 35 percent goes to newspapers and 5 percent to magazines/tabloids.

The top program genres remain the soap operas - locally called the 'sinetrons' - rivaled closely by reality programming. 'Cinta Fitri' (sinetron) on SCTV, 'Ter Mehk Mehk' (reality ) on Trans TV and FremantleMedia's 'Take Me Out Indonesia' (reality) on IVM were the top performing programs that stood out.

Chaudhuri revealed that there were no significant changes in top programming.

"The genres have largely been the same in the last few years. Experimentation with formats from overseas markets is likely to continue, and so 'sinetrons' will continue to be staple favorites," he said.

Asked about Indonesia's perceived dominance by Media Nusantara Citra (MNC), Chaudhuri said, "It is not that clear a dominance - assuming you are referring to the MNC group - which operates Global TV, RCTI, TPI and Indovision. Primarily because they do not operate as a single entity and the core cash cow - RCTI - is locked in a three - way battle for channel share with SCTV and TRANS. So it is always possible for an advertiser to play the balancing game to meet brand objectives and cost targets."

The growth potential of Indonesia's pay - TV market, meanwhile, has always been significant, but hampered variously by inconsistent legislation and signal piracy.

According to Rudy Tanoesoedibjo, Director MNC Sky Vision (MSV), the pay - TV operator was gaining impressive subscriber numbers monthly, only to see substantial numbers being eroded by signal pirates. Pak Rudy is now talking of growth outpacing attrition. And it's a positive sentiment widely echoed amongst the pay - TV fraternity, that political stability and internal action against the pay - TV pirates bode well for long - term growth.

Much of MNC Sky Vision's recent growth was made possible by the May 2009 launch of its latest satellite INDOSTAR-II, doubling their capacity. "This has resulted in improvement of the quality and very excellent delivery of the service," said Pak Rudy, "as well as increasing our capacity. Before we had 4.5 transponders, now we have 10 fully functioning transponders."

Another major factor in MSV's growth has been the launch of Top TV, a new service offering lower-level price points. "Indovision was indeed perceived as a premium product, it was a perception we engineered to appeal to higher - spending demographic. So Top TV is targetted at those people who can't afford (or think they can't) Indovision."

But Pak Rudy says that their research has shown that those people who can afford Top TV, can actually afford Indovision. "So our strategy is to attract them to Top TV and then upsell to Indovision. People like to move up rather than down."

He also talks about how capacity has helped boost their content offerings, such as the recently - launched 24-hour Golf Channel. "We have many things on an exclusive basis."

Asked about the popularity of their in - house comedy channel, Pak Rudy said that many channels that buy third - party content are not suitable for the MSV platforms. "So it is better for us to locally package channels, like the comedy channel. There has been a very positive response from subscribers and we have other in - house channels planned." Another interesting development was MSV's commitment to HDTV at the signing of an MoU between MSV and Samsung to supply Decoders or Set - Top Boxes (STB).

"Provision of the STB is also Indovision's first step into the High - Definition Television (HDTV) and to encourage local components," said Rudy. "This is a form of our commitment to be a great player and to keep leading in this industry."

Rudy described the pay - TV industry as a very prospective business in Indonesia, with Indovision claiming a dominant 70 percent share of the pay - TV market in Indonesia. On the anti - piracy side of the business, the Government is currently in the process of applying effective laws and regulations to stop illegal cable TV operators which are located rurally and in cities outside Jakarta.

Based on the information from Association of Indonesia Multimedia Provider (APMI) and Association of Indonesia Cable TV Entrepreneur (APTEKINDO), currently there are approximately 680-2,500 illegal cable TV operators with the total number of subscribers reaching about 2 million households, which is bigger than the operator's legal subscribers and gross income.

Says Pak Rudy, "Many things have changed, we are very happy to be receiving such support from our channels and from the Government. In Indonesia there is a potential market of about 10 million, we estimate 12-15 million subscribers can afford pay TV."

Pak Rudy estimated current subscriber numbers, for both Indovision and Top TV, at around 670,000, with 1 million subscribers the next major milestone in MSV's sights. "We are very confident of achieving this milestone very soon. Even now, we have a very significant competitive advantage - my short term goal is the 1 million mark." AG

Research and Markets: 2010 Taiwan Games Market Summary Report.(Report)

DUBLIN -- Research and Markets (http://www.researchandmarkets.com/research/be1242/2010_taiwan_games) has announced the addition of the "2010 Taiwan Games Market Summary Report" report to their offering.

Online Game Market Snapshot Taiwan's online game market revenue should reach $XX million USD in 2010, up XX% from 2009. In 2009 the market reached $XX million, up XX% over 2008. Niko estimates that there are XX million Taiwanese gamers in 2010 rising to XX million by 2014, and the biggest growth in gaming usage is in the social networking service (SNS) games such as on Facebook.com. Facebook usage has skyrocketed since Q2 2009 and now has nearly reached saturation in Taiwan. According to Inside Facebook, Taiwanese registered Facebook users rose from XX to XX million in 3 short quarters between Q2 2009 and Q1 2010. Despite slowing growth of online game service revenues, we expect Taiwan's market to benefit by the sudden surge in popularity of SNS games the way that other global markets, including mainland China, have done.

Free to play (F2P) games and social networking service (SNS) games are rising in popularity worldwide. In Taiwan, where there has been a bleak economy, some news articles suggest that unemployed workers were spending more and more time at home playing free games. This could boost the number of total gamers, and those people will likely remain hooked even after they regain employment. Of all segments of online games, the Taiwanese gamers in Nikos online survey say that they spend XX% of their time on MMORPGs, XX% on advanced casual, XX% on casual games and XX% on SNS games.

The F2P model works for the Taiwanese culture. Currently, there are a few time-based games such as Lineage, Lineage II, AION, World of Warcraft and Ragnarok Online (also available as F2P on separate servers). But the majority of games are F2P.

The average revenue per user is roughly equivalent to that of mainland China at just under $XX USD per month.
